A trade mark (popularly known as brand name) in layman’s language is a visual symbol which may be a word signature, name, device, label, numerals or combination of colors used by one undertaking on goods or services or other articles of commerce to distinguish it from other similar goods or services originating from a different undertaking.

  • Trademark Search
    • Trademarks include word marks, device marks, holograms, sound marks, etc. Trademark Search is a process where the firm does a research on the brand name or the logo that the client has provided us through various methods, in such a way that we are able to register the trademark successful. This search is an important process because there might be a number of existing word marks or logos already existing which may cause a hindrance to the registration of the trademark provided to us by the client. This process is also important to avoid any opposition from any third party or objection from the Registry in the future. Trademark search comprises of a complete peripheral search and as well as an in depth search.

  • Trademark Advisory, and suggestions
    • After completion of the Trademark Search, if we feel that certain trademark needs to altered, corrected or deleted, we give an honest feedback about how likely is it to get registered without any challenges. We aim towards direct registration and avoid any kind of objection or opposition.

  • Trademark Category Research and Drafting
    • There are different classifications or categories under which the goods and services are described in the Trademark. We do a complete research into every category as to determine in which category or classification the clients trademark lies. There is a possibility that the goods and services may fall into more than one category, we work around the best course possible in order to get the trademark accepted and registered. We do the category drafting in such a way that the trademark does not face any objection or opposition in the future.

  • Trademark Filing
    • Once the search is clear, brand name or logo is finalised, classification of the trademark is completed, we file the trademark with the India Trademark Registry with the necessary legal paper work.

  • Legal Paper work
    • It basically comprises of a Power of Attorney and a Stamp Paper (Stamp Duty varies from state to state). This is a door step service for the same to the client’s office or residence. All the documentation shall be taken care by the experienced legal team at the firm.

  • Trademark Objection clarification, and reply to opposition
    • In any unfortunate scenario where the trademark faces any objection from the Registry or faces an opposition by any third party, we ensure that a reply is carefully drafted to the objection or the opposition. We make sure that clarification is given as to why the client’s trademark is unique and should be registered.

  • Trademark Prosecution and Defense
    • In most of the cases, even after replying to an objection or opposition there is a need to go into hearing so as to comply with the principles of natural justice. Our firm makes sure that the trademark is not out rightly rejected and is given a chance to be heard as to why it is to be registered, before the Registrar of Trademarks. We also makes sure that any evidence that is to be required to be given is rightly given to make sure that the trademark is registered successfully.

  • Follow up with the Registry and related authorities.
    • Once the trademark is accepted and registered, a time to time follow up is done between the firm and the Trademark registry right from the first stage of trademark filing, registration to its renewal. The firm keeps a tab as to any new notification regarding the client’s trademark, such as, any objection or opposition. We keep the client updated regarding the status of the trademark.
