Copyrights

Copyright is a right given by the law to creators of literary, dramatic, musical and artistic works and producers of cinematograph films and sound recordings. In fact, it is a bundle of rights including, inter alia, rights of reproduction, communication to the public, adaptation and translation of the work. There could be slight variations in the composition of the rights depending on the work.

Classes of works for which copyrights protection is available in India

Musical work:Musical work means the work consisting of music notes written in any graphical notion but does not include alphabets or any words which act as instructions to be sung, spoken or performed.

Artistic work:Copyright applies to all works of an artistic nature including, but not limited to, photographs, paintings, sculptures, maps, charts, graphs, diagrams, cartoons (static not moving animations), logos, engravings, sketches, blueprints and buildings or models of buildings. Protection is also given to works of artistic craftsmanship which can include crafts, embroidery, ceramics, woodworking and jewellery.

Cinematograph film:Cinematograph film includes motion pictures of all kind. Cinematograph can be defined as any work of visual recording on any medium.

Sound recording:sound recordings as “works that result from the fixation of a series of musical, spoken, or other sounds but not including sounds accompanying a motion picture or other audio-visual work.” Generally, a sound recording is a recorded performance, often of another work. A sound recording must be fixed, meaning that the sounds must be captured in a medium from which they can be perceived, reproduced, or otherwise communicated.

Computer programs (Software):Computer programs include an algorithm, which is considered as a literary work under Indian Copyright Act, 1957. A computer program is a set of statements or instructions to be used directly or indirectly in a computer in order to bring about a certain result. Copyright for computer programs prohibits copying of program structure and design.
